Agreement
By accessing or using the Will Mac Daddy website (“Site”), you agree to these Terms of Service (“Terms”) and our Privacy policy. If you do not agree, do not use the Site.
About the Site
Will Mac Daddy is an independent fan hub. We are not affiliated with Rockstar Games, Take-Two Interactive, or their affiliates. Game names and marks belong to their respective owners. The Site is provided for entertainment and community discussion.
Eligibility and accounts
You must be old enough to enter a binding contract where you live and meet any minimum age we state for specific features. You are responsible for your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access (see Support).
Acceptable use
You agree not to:
- Violate law or infringe others’ rights (including intellectual property and privacy);
- Harass, threaten, abuse, or discriminate against others;
- Post malware, scrape or overload the Site, or probe or bypass security;
- Impersonate people or entities, or misrepresent your affiliation;
- Use the Site to send spam or unsolicited commercial messages;
- Collect personal data about users without proper consent and lawful basis.
We may remove content, suspend accounts, or take other action we consider appropriate.
Forum and user content
Posts, usernames, and other material you submit (“User content”) are your responsibility. You retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute User content as needed to operate and promote the Site and forum. You represent you have the rights to grant this license.
We may moderate or remove User content at our discretion. We are not obligated to monitor all content but may do so. Opinions expressed by users are theirs alone.
Store and merch
Merchandise purchases are processed by Fourthwall and its partners. Pricing, shipping, returns, taxes, and support for orders are governed by Fourthwall’s terms and policies, not by us. Links to the store may leave our Site; your relationship for purchases is with those providers.
Intellectual property
The Site’s design, branding (except third-party marks), and original content we provide are protected by applicable laws. You may not copy, modify, or distribute them without permission, except as allowed by law or for normal personal browsing.
Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee accuracy, completeness, or availability of any content (including intel, news, or forum posts). Rumors and speculation are not official statements from any game company.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILL MAC DADDY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US DIRECTLY FOR THE SITE IN THE SIX MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), EXCEPT WHERE LAW DOES NOT ALLOW SUCH A CAP.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.
Indemnity
You will defend and indemnify us and our operators against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User content, your use of the Site, or your violation of these Terms.
Termination
We may suspend or terminate access to the Site or your account at any time, with or without cause or notice. Provisions that by their nature should survive (including disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
Changes
We may modify these Terms by posting an updated version on this page and changing the “Last updated” date. Your continued use after the effective date constitutes acceptance of the revised Terms, except where required law mandates a different process.
Governing law
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts in Delaware (or another venue we specify in a future update) have exclusive jurisdiction for disputes, subject to non-waivable rights you may have in your home jurisdiction.
Note: If Delaware is not appropriate for your operation, replace this section with your lawyer’s choice of law and venue.
